These Terms of Service (“Terms”) govern your access to and use of our website, products, and services, including AI powered communication systems, automation tools, websites, chat widgets, and related business services.

By accessing or using our services, you agree to be bound by these Terms.

Our services are intended solely for business and commercial use.

By using our services, you confirm that:

You are at least 18 years old

You are acting on behalf of a business or organisation

You have authority to enter into legally binding agreements on behalf of that business

4D Digital Strategies provides business automation and digital services, including but not limited to:

AI receptionist systems

AI voice and chat automation

Website design and optimisation

Lead capture systems

SMS and email automation

CRM integrations

Reputation and review management systems

Customer communication workflows

Our services are primarily designed for trades and service based businesses, including electricians, plumbers, builders, joiners, and similar industries.

We reserve the right to modify, improve, suspend, or discontinue any part of our services at any time.


4. Client Responsibilities

You agree to:

Provide accurate and lawful information

Maintain responsibility for communications sent through your systems

Review and monitor AI generated outputs where appropriate

Comply with all applicable laws and regulations

Obtain any legally required consents from your customers

You remain responsible for your business operations and customer interactions, including communications handled through AI systems.


5. Payments & Billing

Subscription Services

Services may be billed on a recurring monthly basis unless otherwise agreed in writing.

Setup Fees

Certain services may include a one time setup or onboarding fee.

Payment Processing

Payments are securely processed through third party payment providers including Stripe.

Late or Failed Payments

Failure to make payment may result in:

Suspension of services

Restricted access to systems

Termination of service agreements

Refunds

Due to the custom and digital nature of our services, fees are generally non refundable once work has commenced or systems have been deployed.

However, where a specific promotional offer or written agreement includes a money back guarantee, eligible refunds will be provided in accordance with the terms of that offer.

Unless otherwise agreed in writing, our standard 30 day money back guarantee applies only to first time clients and only within the first 30 days of service commencement.

We reserve the right to refuse refund requests where there is evidence of misuse, abuse of the service, or violation of these Terms.

Nothing in these Terms excludes your statutory rights under applicable UK law.


6. No Guarantee of Results

While our services are designed to improve operational efficiency, lead management, and customer communication:

We do not guarantee specific business results

We do not guarantee increases in revenue, leads, bookings, or conversions

Outcomes depend on factors outside our control, including your business operations, market conditions, and customer behaviour

Any examples, demonstrations, or projections provided are illustrative only.


7. AI Systems & Automation

Our services may use artificial intelligence, machine learning, and automated workflows.

By using our services, you acknowledge and agree that:

AI systems may occasionally generate inaccurate, incomplete, or unexpected outputs

AI systems should not be relied upon as a substitute for professional judgment

You are responsible for reviewing important communications and business decisions

Human oversight may still be involved in service delivery

AI Disclosure Responsibility

Where legally required, you are responsible for informing your customers when they are interacting with AI systems or automated communication tools.


8. Acceptable Use

You agree not to use our services for:

Illegal or unlawful activities

Spam or unsolicited communications

Fraudulent or misleading activity

Harassment, abuse, or harmful conduct

Misrepresentation or impersonation

Activities that may damage our systems, reputation, or legal standing

We reserve the right to suspend or terminate services where misuse is identified.


9. Intellectual Property

Our Intellectual Property

All systems, software, workflows, templates, automation structures, branding, and proprietary processes developed by 4D Digital Strategies remain our intellectual property unless otherwise agreed in writing.

Your Data & Content

You retain ownership of:

Your business information

Customer data

Business assets and materials supplied by you

You grant us permission to use such materials solely for the purpose of providing our services.


10. Data Protection & Privacy

Your use of our services is also governed by our Privacy Policy.

We process personal data in accordance with:

UK GDPR

Data Protection Act 2018

Applicable UK privacy and electronic communication laws

You remain responsible for ensuring your own business complies with relevant data protection obligations when using our services.


11. Service Availability

We aim to provide reliable and uninterrupted services wherever reasonably possible.

However, we do not guarantee:

Continuous uptime

Error free operation

Uninterrupted access

Compatibility with all third party systems

Temporary interruptions may occur due to maintenance, updates, third party outages, or circumstances beyond our control.


12. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for indirect, incidental, consequential, or loss of profit damages

We are not liable for business interruption, data loss, or reputational damage arising from use of our services

Our total aggregate liability shall not exceed the amount paid by you to us during the 30 days preceding the claim

Nothing in these Terms excludes liability that cannot legally be excluded under UK law.


13. Termination

We may suspend or terminate access to services if:

Payments are overdue

These Terms are breached

Your use creates legal, security, or reputational risks

You may cancel services in accordance with your agreed billing arrangement.

Termination does not remove any outstanding payment obligations.

We may update these Terms from time to time.

Updated versions will be published on our website with a revised effective date.

Continued use of our services after updates constitutes acceptance of the revised Terms.


15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.
